ADVANCEMENT OF CHARGES:
Upon request, Air Cargo PDX/Explore Airtrans Services  will advance the charges for transportation, cartage, storage, loading, unloading, unpacking, packing, and processing NOT performed by Air Cargo PDX/Explore Airtrans Services, when sufficient guarantee is given either by the shipper or consignee that such charges will be paid.

LIABILITY OF CHARGES:
The shipper and consignee shall be liable, jointly and severally, for all unpaid charges payable on account of a shipment including but not confined to, sums advanced or disbursed by Air Cargo PDX/Explore Airtrans Services on account of such shipment.

INDEMNIFICATION:
The shipper and consignee shall be liable, jointly and severely, to pay and/or indemnify Air Cargo PDX/Explore Airtrans Services for all claims, fines, penalties, incurred, suffered or dispersed by Air Cargo PDX/Explore Airtrans Services by reason of: (1) any violation of any of the rules contained in these terms and conditions; (2) any other default of the shipper or consignee or other parties with respect to such shipment, or; (3) an action taken by Air Cargo PDX/Explore Airtrans Services for the collection of freight charges due on any such shipment.

NOTICE AND DISPOSITION OF PROPERTY:

  1. Air Cargo PDX/Explore Airtrans Services will promptly notify the consignee of the arrival of the shipments, except when delivery service is to be provided by Air Cargo PDX/Explore Airtrans Services.  If, at the expiration of the free storage time provided, a shipment containing nonperishable property is unclaimed or delivery cannot be affected, Air Cargo PDX/Explore Airtrans Services PDX will so notify the shipper and consignee, by mail, at the address shown on the airbill. Upon written instructions from the shipper, Air Cargo PDX/Explore Airtrans Services will return the shipment to the shipper, forward or re-consign it, or otherwise dispose of it, all at the shipper expense.
  2. If a shipper or consignee desires notification by telephone call or e-mail when a shipment is delayed in the possession of Air Cargo PDX/Explore Airtrans Services, threatened with deterioration, unclaimed or delivery cannot be affected, authorization and instructions for such notification, including the name, telephone number, and/or address of the party to be notified, shall be given on the airbill. If such authorization and instructions concerning the disposition are given, Air Cargo PDX/Explore Airtrans Services will take such steps as due diligence requires for the protection of all parties in interest, including re-routing the shipment by other means of transportation without further notice to the shipper or consignee.

CLAIMS PROCEDURE:
In the case of shipments moving between points in the United States, the following rule shall apply:
  1. Receipt of the shipment by the consignee without written notification of loss or damage on the delivery receipt will be prima facie evidence that the shipment was delivered in good condition.
  2. Damage and/or loss discovered by the consignee after delivery when no notification of loss or damage has been made on the delivery receipt by the consignee upon receipt of the shipment must be reported to Air Cargo PDX/Explore Airtrans Services at destination. The shipment, its container(s) and its packing material must be made available to Air Cargo PDX/Explore Airtrans Services for inspection at the delivery located shown on the airway bill. A written claim must be filed within 48 hours of receipt of the shipment.

ROUTING AND RE-ROUTING:
Air Cargo PDX/Explore Airtrans Services, exercising due diligence in order to protect all shipments accepted for transportation, will determine the routing of all shipments.

PICKUP AND DELIVERY SERVICE:
  1. Pickup and/or delivery service will be provided during business hours Monday through Friday (excluding Federal Holidays). Saturday and or Sunday pickup and delivery service is available on request, except as noted in Paragraph 2.
  2. Pickup and/or delivery service will not be provided:
    1. When, because of conditions beyond Air Cargo PDX/Explore Airtrans Services control, it is impractical to operate vehicles.
    2. To and from any address not directly accessible to vehicles.

CARTAGE AGENTS PICKUP / DELIVERY SERVICE:
When a customer elects to use a cartage agent to pickup or deliver a shipment on a customer's behalf to/from an Air Cargo PDX/Explore Airtrans Services office, we retain the right to bill the customer for the cartage agent's charges.

HOLD/DROP OFF SHIPMENTS:
Shipments that are routed by the customer "Hold for Pickup" and shipments that are "drop off" by the customer at an Air Cargo PDX/Explore Airtrans Services office may be rated with a discount.

SPECIAL PICKUP AND DELIVERY SERVICE:
1. On request, Air Cargo PDX/Explore Airtrans Services will perform a special pickup at a shipper’s door by dispatching or re-routing an exclusive vehicle that will deliver the shipment directly to the airport to connect with the earliest possible flight. A "Special" charge will be assessed.
2. On request, Air Cargo PDX/Explore Airtrans Services will perform a special delivery to a consignee's door by dispatching or re-routing an exclusive vehicle that will deliver directly from the airport. A "Special" charge will be assessed.

SATURDAY PICKUP AND DELIVERY SERVICE:
Saturday pickup and delivery is available for all Air Cargo PDX/Explore Airtrans Services shipments on request. A "Special" charge will be assessed.

HOLIDAY/SUNDAY PICKUP AND DELIVERY SERVICE:
1. Shipment picked up or delivered on a Federal Holiday would be rated as an Overnight shipment with a "Special" pickup or delivery charge.
2. If a shipment picked up or delivered on a Federal Holiday requires premium routing, Same Day Service rates will apply.

RE-DELIVERY SERVICE:
A shipment which, through no fault of Air Cargo PDX/Explore Airtrans Services, cannot be delivered on the first tender of delivery to the consignee will be returned to Air Cargo PDX/Explore Airtrans Services station and the consignee will be notified. Re-delivery will be made only upon request of consignee. Additional charge for redelivery will be assessed. If after three (3) business days from the date of notification to the consignee the shipment still cannot be delivered the terms and conditions of the "storage" rule in this tariff will apply.

LOADING AND UNLOADING INCIDENTAL TO PICKUP AND DELIVERY SERVICE:
Loading and unloading incidental to pickup and delivery service will ordinarily be performed by one man; pickup and delivery service will not be provided for pieces which cannot be handled by one man unless advance arrangements have been made. Additional charges may apply.

APPLICATION OF WAITING TIME CHARGES:
When vehicles are held for loading or unloading, a charge at the rate of $50.00 per hour, per vehicle, will be made for all time in excess of 15 minutes. Charges based on time will be computed by multiplying the hourly rate by the time involved. Unless otherwise provided, fractions of an hour will be rounded up to the next half hour.

PROOF OF DELIVERY:
The time of delivery of a shipment to the consignee will be telephoned to shipper upon request, provided such request is made not later that the time shipment is tendered to Air Cargo PDX/Explore Airtrans Services. When requested by the shipper or consignee, Air Cargo PDX/Explore Airtrans Services will furnish a photo-copy of the airbill, bill of lading, or manifest signed by the consignee or his agent as proof of delivery.

BUSINESS DAYS / FEDERAL HOLIDAYS:

  1. "Business Day" means Monday through Friday, 8:00 A.M. through 5:00 P.M. except for all days recognized as Federal Holidays.
  2. Deliveries normally scheduled to be made on a day of Federal Holiday observance will be rescheduled to be delivered on the following business day.

SERVICE STANDARDS:

Service between communities in the continental United States (CONUS)

  1. Service between communities in the continental United States (CONUS)
    1. Shipments that are picked up and delivered within a 60 mile radius of a major airport city will receive the following service:
      • Overnight/Standard Shipments - Next Business Day
      • Second Day Shipments - Second Business Day
      • Economy Shipments - Three to Five Business Days
    2. Shipments that are picked up or delivered beyond a 60 mile radius of a major airport city will receive the following service:
      • Overnight/Standard Shipments - Second Business Day
      • Second Day Shipments - Third Business Day
      • Economy Shipments - Four to Seven Business Days
    3. Shipments that are picked up and delivered beyond 100 mile radius of a major airport city will receive the following service:
      • Overnight/Standard Shipments - Third Business Day
      • Second Day Shipments - Fourth Business Day
      • Economy Shipments - Six to Ten Business Days
    1. When an Overnight/Standard Service and Second Day Service shipment, because of size, weight, shape or contents cannot be accommodated on an aircraft, and must be re-routed by surface transportation for part or all of its movement, delivery may require an additional day. Overnight rates will apply on a re-routed shipment delivered on the second business day, and Second Day rates will apply on a re-routed shipment delivered on the third day.
    2. Overnight Service and Second Day Service shipments must be ready for pickup by 4:00 P.M. and called into an Air Cargo PDX/Explore Airtrans Services office for pickup prior to 2:00 P.M. Shipments that are ready after 4:00 P.M. and/or called into an Air Cargo PDX/Explore Airtrans Services office after 2:00 P.M. may require an additional day for delivery.
    3. The delivery standard on a Same Day Shipment will be the time and date quoted by Air Cargo PDX/Explore Airtrans Services, based on the time the shipment is ready for pickup. Because of shipment size, weight, shape, destination, and ready time, a Same Day shipment may be delivered on the same day it was picked up, the next business day or the second business day. Same Day Service rates will apply when the shipment was delivered on or before the time quoted by Air Cargo PDX/Explore Airtrans Services prior to pickup.

REFUND PROVISION (Applicable on Overnight Only):
If a shipment is not delivered to the consignee's address consistent with the required delivery shown on the shipping manifest. Through no fault of the shipper, the carrier agrees that charges assessed will be based on the date the shipment was actually delivered

ELECTRONIC REQUESTS FOR SHIPMENTS:
Any and all requests made by electronic transmission to Air Cargo PDX/Explore Airtrans Services either by fax or by internet web page form shall be considered solely a request for service, and become an airbill agreement only at the time the shipment is actually tendered to Air Cargo PDX/Explore Airtrans Services. Any delays in the initiation of shipment caused by a failure in technology are not the responsibility of Air Cargo PDX/Explore Airtrans Services.
